Important: Extension of the transitional ordinance on residence in Ukraine in an adapted form

On July 8th, 2022, the Federal Council approved the extension of the Ukraine Residence Transitional Ordinance. Refugees from Ukraine can therefore also enter Germany without a visa after August 31, 2022 and stay legally in Germany. However, the regulation was changed so that the visa-free stay is now only valid for 90 days. The amended regulation will come into force on September 1st, 2022.

The restriction of the visa-free stay to 90 days means that all those who have already been staying in Germany for more than 90 days on September 1st, 2022 can now apply for a residence permit in accordance with Section 24 (1) before September 1st, 2022 AufenthG in order to trigger the fictional effect of Section 81 (3) AufenthG. Otherwise, the stay after September 1st, 2022 is unlawful. Those entering Germany after September 1st, 2022 must act accordingly within 90 days of arrival. The regulation only applies to people who enter Germany by November 30th, 2022.

The European Union has enacted the so-called Mass Influx Directive. This clears the way throughout the EU for refugees from Ukraine to be granted a humanitarian residence permit without having to go through an asylum procedure first. As a result, protection seekers from Ukraine have access to work, education as well as social benefits and medical care throughout Europe. We refer to multilingual information offers.

Language courses

Work

  • With a residence permit according to §24 of the Residence Act, people who have fled Ukraine receive an employment permit in Germany immediately.
  • For this, they must register as seeking protection.
  • Even a „Fiktionsbescheinigung“ (fictitious certificate) with the entry „employment permitted“ secures access to the labour market.
  • Self-employment and employment are permitted

  • The Federal Employment Agency is responsible for job placement and job promotion. It has launched a hotline with language mediation for refugees from Ukraine: telephone number 0911 178 7915 (Monday to Thursday 8 a.m. to 4 p.m., Friday 8 a.m. to 1 p.m.). Training

  • School-based or vocational training may also be taken up.

Study

  • Refugees from Ukraine with university entrance requirements may apply for or enrol in degree programmes in Germany.

Driving licence

  • The EU recognizes Ukrainian driving licenses from refugees, whon are granted residence on humanitarian grounds, such as under section 24 of the Residence Act. The regulation is valid until the 6th of March 2025 and has been in force since the 27th of July.
  • The professional drivers licence is not recognized immediately. In order to receive a driver qualification certificate, an additional compulsory training of at least 35 hours and an examination at the responsible IHK (Art. 4 Para. 4 of the regulation) are required. The Federal Ministry of Transport is currently working together with the federal states, the Federal Motor Transport Authority, the Federal Printing Office and the DIHT to create the necessary procedures and legal bases for the temporary recognition of Ukrainian professional driver qualifications in Germany, which are required by the EU.
